Stockport, United Kingdom (30th October, 2012) – Carter and Carter Solicitors, professional personal injury solicitors in Manchester, comment on the new APIL findings which could see independent holidaymakers receive less compensation to package deal tourists.
The Association of Personal Injury Lawyers (APIL) has recently highlighted an issue that could occur when holidaymakers book a trip independently rather than with a package deal.
Compensation claims can be made under English Law and in the English courts against a tour operator if a package holiday member suffers an injury. However, if the package tour applications are not applied then claiming compensation for an injury can be quite complicated, as the victim will have to claim compensation in the country where the accident occurred. Also, even if the claim is successful, the recoverable amount might be lower in comparison to the UK due to the different foreign laws governing the claim.
The European Commission (EC) is currently considering extending the law for victims of road accidents abroad. The APIL is now encouraging the EC to change the law more broadly so it protects people as a whole, and could ultimately ensure the victims can receive a remedy in their own country which is in line with their nation’s laws.
A spokesperson for Carter and Carter Solicitors commented: “There is currently a two tier system which depends on whether an injured person booked their holiday independently or as part of a package deal. Not only is this wrong and unfair on the person who has booked their trip independently, but it will almost certainly present them with a much more difficult task in recovering injury compensation, and they could potentially receive less compensation than a package deal counterpart.”
