Cheshire, United Kingdom (2nd October, 2012) – Poole Alcock LLP, professional, qualified and experienced solicitors in Chester, comment as the Legal Services Board proposes that will-writing, estate administration and probate should strictly be carried out only by regulated legal professionals.
In a bid to improve existing regulation, The Legal Services Board has announced that it is preparing to recommend to the Lord Chancellor that specific estate administrative services should be considered reserved activities.
This amendment to the current legislation would mean that these services could only be performed by solicitors, barristers, legal executives, or other professionals who are regulated within the requirements of the Legal Services Act 2007
The Legal Services Board will make their final recommendations to the Lord Chancellor in early 2013.

“All too often it is the fallout of a badly drafted will that means that solicitors have to become involved. If a solicitor had been involved at the start then those later problems, and the cost of putting them right, could well have been avoided entirely.
“We hope that the Lord Chancellor will seriously consider the Legal Services Board’s suggestions in order to ensure a consistent level of expertise throughout the will-writing process.”
